Accommodation Rules

General Terms and Conditions of the Accommodation Contract

I. Terms and Conditions of Concludingthe Accommodation Contract

a) By signing the Guest Register Card, the accommodated person (hereinafter referred to as ‘Guest’) concludes the Accommodation Contract with JLV a.s. (hereinafter referred to as ‘Hotelier’) under conditions set forth herein and in theAccommodation Contract.

b) Accommodation is provided for consideration. The amount of consideration is set according to the current price list by agreement of the Parties and accepted by the Guest’s by signing the Guest Register Card. Accommodation in these AccommodationRules means using the following premises intended for accommodation: rooms, pavements, terraces and corridorsleading to staircases (hereinafter referred to as ‘Premises Intended for Accommodation’).

The price of accommodation is due at the beginning of the stay at the latest. Payment shall be made in cash or by credit card. Payment upon issuance of the invoice can only be made upon prior agreement with the Hotelier.

II. Compensation for Damage

a)In the event of damage caused by the Guest, the Hotelierhas the right to seek compensation for damage.

b) The Guest shall be obliged to pay full compensation for any damage caused by him/ her on the Premises Intended for Accommodation including loss of profits worth current price of accommodation for the whole period when the Premises are out of operation. This obligation extends to the events in which damage has been caused by children or any other person accommodated with the Guestor an animal which is travelling with the Guest.

III. Reservation Methods

Reservation of accommodation can be made in person, via email or telephone. Reservationshall only be considered valid uponwritten confirmation by the Hotelier. In the event of group reservation or reservation of several rooms, the Hotelier can require an advanced payment in cash, using bank transfer or by credit card.

IV. Rights and Obligations of the Guest

a)The Guest has the right to use the Premises Intended for Accommodation and all the equipment according to the Equipment List in compliance with the principles of sound management. The Guestshall obtain the keys to the hotel room upon check-in. The Guest is obliged to avoid losing the keys orlending them to persons who are not accommodated in the room, and to protectthe keys from being stolen. In the event of loss or any other misuse of the keys, the Guest is obliged to pay to the Hotelier a contractual penalty of 500 CZK. Thereby the right of the Hotelier to seek compensation for damage remains unaffected.

b)The Guest is obliged to:

-     pay the price of accommodation according to the current price list;

-    pay for any other used hotel services, for example parking in the hotel car park;

-     complete the Guest Register Card properly, completely and legibly at the check-in. Foreignnationals who are under visa obligation must provide the visa number. For this purposes the Guest must show proof of identity such as identity card or passport;

-    use properly the Premises Intended for Accommodation and to maintain order and cleanliness on the Premises;

-    protect the equipment and appliances located on the Premises Intended for Accommodation from damage;

-    ensure protection of beds and sofas from being polluted by children who are not able to maintain their personal hygiene. This also applies to pets accommodated in the room;

-    read and acknowledge the Hotel Accommodation Rules andabide by them;

-    notify the Hotelier without undue delay of necessity to carry out repair works or of any damage caused by the Guest on the Premises Intended for Accommodation;

-    behave between 22:00 and 7:00 so as not to disturb the others quests by excessive noise;

-    check out by 10:00 on the day of departure; a later check-out is only possible upon agreement with the Hotelier. The Guest must notify the Hotelier of the intended check-out after 10:00at least one day in advance.  The Guest shall be charged 10 EUR per roomfor the check-out between 10:00 and 14:00.  The Guest shall be charged 20 EUR per roomfor the check-out between 14:00 and 17:00. In the event of check-out after 17:00, the Guest shall be charged equivalent of one night’s accommodation per room.

c) Without the Hotelier’s consent the Guest is not allowed to:

-    carry out sufficient changes on the Premises Intended for Accommodation (move furniture, equipment, etc.);

-    remove any equipment or appliances from the Premises Intended for Accommodation;

-    use his/her own personal appliances except personal computerson the Premises Intended for Accommodation without prior notification of the Hotelier or despite the Hotelier’s ban;

-    leave the Premises Intended for Accommodation to another person;

-    claim the address of the Premises Intended for Accommodation as the place of his/her business or as his/her permanent address.

d) On the Premises Intended for Accommodation the Guest is not allowed to:

-    carry weapons, ammunition and explosives orshelter them in a condition allowing their immediate use;

-    possess, produce or shelter illegal drugs, psychotropic substances or poisons except medicaments which have been prescribed to the Guest by a doctor;

-    smoke inside the hotel.

V. Obligations of the Hotelier

The Hotelier is obliged to:

-    deliver the Premises Intended for Accommodation to the Guest in the condition suitable for their proper use and ensure undisturbed exerciseof his/her rights related to accommodation;

-    ensure perfect technical and hygienic condition on the Premises Intended for Accommodation.

VI. The Guest’s Vehicle and Valuables

The Guest can park his/her vehicle in the adjoining car park in front of the hotel.  These parking spaces are unguarded and freely accessible from the adjoining area therefore the Hotelier is not liable for the events giving rise to any damage to the car, car theft or theft of any belongings left in the car. The Hotelier strongly advisesthe hotel guests not to leave their jewellery, money and other valuables on the Premises Intended for Accommodation. The Hotelier advises the hotel guests to store their valuables in the hotel reception safe.

VII. Room Cleaning Service

In the event of a long stay, the bed linen is changed after the first week of stay and there after once a week. Hand towels and bath towels are changed upon the Guest’s request.

VIII. Pets

The Guest is permitted to bring a pet upon obtaining prior consent of the Hotelier.  The Guest shall be charged a fee of 150 CZK for the pet. The Guest is responsible for the pet and must ensure that the pet does not endanger the other hotel guests or the hotel employees.

IX. Withdrawal from the Accommodation Contract before Arrival or during the Stay

a)The Guest is entitled to withdraw from the Accommodation Contract one (1) day before the day of arrival without giving reasons. In the event of late cancellation or non-arrival, the Hotelier shall be entitled to charge the Guest equivalent of one night’s accommodation. In the event of reservation denominated on the reservation portal or in the email confirmation as ‘non-refundable’ or using an expression with a similar meaningwhich implies that the Guest shall not be paid any refund in the case of cancellation, the Guest shall be obliged to pay the full price of the reserved accommodation and shall not be entitled to a refund of the advanced payment made for accommodation.

b)The Hotelier has the right to withdraw from the Accommodation Contract in the event of gross violation of the obligations set forth herein or infringement of principles of morality by the Guest on the Premises Intended for Accommodation.

c)In the event of withdrawal from the Accommodation Contract, the Hotelier’s contractual claims in excess thereof remain unaffected.

d)In the event of withdrawal from the Accommodation Contract, the Hotelier reserves the right to require the Guest to leave the Premises Intended for Accommodation.

e)In the event that the Guest requires to shorten the length of the reserved, paid and started stay, the Hotelier must be notified of the planned termination at least one (1) day in advance. In this case the Guest shall be refunded equivalent of the number of the notified nights’ accommodation. In the case of regular guests, the Hotelier can transfer the equivalent of the refund as a credit to the next stay with the Guest’s consent.  

X. Extrajudicial Settlement of Consumer Disputes

The accommodated Guest has the right to file a petition for extrajudicial settlement of a consumer dispute with the competent authority, which is:

In compliance with the provisions of section 1837, paragraph j) of Act No. 89/2012 Coll., the Civil Code, the Guest as a consumer shall not be entitled to withdraw from the Accommodation Contract if the Hotelierprovides accommodation within the specified period.

XI. Information on Processing of Personal Data

The Company JLV, a.s., ID No.: 452 72 298, with its registered office at Chodovská 228/4, Prague 4, zip code 141 00, registered in the Commercial Register kept by the Municipal Court in Prague, file No. B 1430 (hereinafter “the Administrator"), processes personal data in accordance with the Regulation (EC) No. 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation ("GDPR") and other related legislation.

The following personal data / categories of personal data are processed so that the Administrator can fulfil the Accommodation Contract and his statutory obligationsrelated to the fulfilment of the accommodation contract: name, surname, residential address, date of birth, ID card or passportnumber, contact e-mail and vehicle number plate, pursuant to the Accommodation Contract and in compliance with the law.

For the purpose of contacting the guest upon termination of the Accommodation, or for the purpose of possible court proceedings related to the fulfilment of the Accommodation Contract, the following personal data / categories of personal data are processed: name, surname, residential address, date of birth, ID card or passportnumber,contact e-mail, information on the date of the Accommodation of the data subject at the Administrator, which is done according to the Administrator's legitimate interest. The legitimate interest of the Administrator in this case is his interest in contacting the data subject due to any possible claims or lost items, as well as for presenting information on the course of the data subject's stay at the Administrator’s accommodation facilities.

Personal data shall be handled manually and automaticallydirectly by the properly authorized Administrator’s employees and then bythe processors authorized by the Administrator according tothe personal data processing contracts.

The list of subjects / categories of recipients to whom the access to the data subject's personal data may be granted: government bodies and authorities, foreign police service, banking institutions.

Personal data shall be stored by the Administrator for 4 years from the termination of the data subject's stay in the case of citizens of the Czech Republic due to the length of the limitation period according to the Czech legislation, and for 6 years after termination of the data subject's stay in case the data subject is not a citizen of the Czech Republic due to the requirement of Czech legislation.

The data subject has the right to access his or her personal data processed by the Administrator, its correction or deletion, or limitation of its processing, and the right to object to processing.

The data subject also has the right to obtain from the Administrator personal data relating to the data subject which the data subject has already provided to the Administrator. Upon request of the data subject, the Administrator shall provide the data to the data subject without undue delay in a structured, commonly used and machine readable format, or shall provide it to another unambiguously appointed administrator. This right does not apply to personal data that is not processed automatically.

The Administrator does not intend to provide personal data to third countries.

If the data subject considers that unauthorized processing of his or her personal data occurs, he or she may address a complaint to the supervisory authority, which is the Office for Personal Data Protection (www.uoou.cz) for the territory of the Czech Republic.

The Accommodation Rules are available on the website www.abitohotel.cz and at the hotel reception. I hereby acknowledge having read and understood the Abito Hotel Accommodation Rules and undertake to a  bide by them.
